These Terms of Service ("Terms") govern your use of the DCDN Cloud platform, website, and services operated by Eastmotion Ltd. ("we", "us", "our"). By creating an account or using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using DCDN Cloud, you confirm that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

5. Plans, Pricing & Payment

5.1 Subscription Plans

DCDN Cloud offers tiered subscription plans (Free, Standard, Pro, Business, Enterprise). Plan features and pricing are listed on our website and may be updated with 30 days' notice.

5.2 Billing

Paid plans are billed monthly in advance via Stripe. By subscribing, you authorize recurring charges to your payment method. All prices are in USD unless otherwise stated.

5.3 Refunds

We offer a 7-day money-back guarantee for first-time subscribers on paid plans. After 7 days, subscription fees are non-refundable. VPS add-on fees are non-refundable once the instance has been provisioned.

5.4 Free Plan

The Free plan is provided as-is with limited features. We reserve the right to modify or discontinue the Free plan at any time.

5.5 DCDN Token Payments

Where available, services may be paid using DCDN tokens. Token transactions are final and non-reversible. Token prices are determined at the time of transaction.

6. Service Level Agreement (SLA)

Business and Enterprise plans include a 99.99% uptime SLA. If we fail to meet this target in a given calendar month, affected customers are eligible for service credits as follows:

SLA credits must be requested within 30 days of the incident. Credits are applied to future invoices and do not constitute refunds. Scheduled maintenance windows are excluded from SLA calculations.

Free, Standard, and Pro plans are provided on a best-effort basis without SLA guarantees.

7. Intellectual Property

You retain all rights to your content hosted on DCDN Cloud. By using our services, you grant us a limited license to cache, distribute, and process your content solely for the purpose of providing the service.

The DCDN Cloud name, logo, and branding are the property of Eastmotion Ltd. You may not use our trademarks without prior written consent, except as allowed under the Affiliate and Reseller programs.

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using DCDN Cloud, you acknowledge that you have read and understood our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Eastmotion Ltd. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of DCDN Cloud.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or any liability that cannot be excluded by law.

11. Disclaimer of Warranties

DCDN Cloud is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

You agree to indemnify and hold harmless Eastmotion Ltd. from any claims, damages, losses, or expenses (including legal fees) arising from:

You may cancel your subscription and delete your account at any time through the dashboard. Upon cancellation, your access continues until the end of the current billing period.

14.2 By Us

We may suspend or terminate your account if:

For non-critical violations, we will provide 7 days' notice before termination where possible. For severe violations (malware, CSAM, active attacks), suspension is immediate.

14.3 Effect of Termination

Upon termination, your data will be retained for 30 days to allow export, after which it will be permanently deleted. VPS instances will be shut down. DNS records will stop resolving after nameserver propagation.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction where Eastmotion Ltd. is incorporated. Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of the applicable jurisdiction.

Nothing in this section limits your right to bring proceedings in the courts of your country of residence if required by consumer protection law.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
